9. Meetups Disclaimer

• nott facilitates online communication between users. However, we are not responsible for any in-person meetings, dates, or interactions that take place outside of the app.

• You acknowledge and agree that any meetings or interactions you engage in with other users are done at your own risk. You are solely responsible for taking the necessary precautions when meeting someone for the first time.

• nott does not conduct background checks on users, and we do not verify the personal information provided by users beyond the quarterly video verification.

• By using the Services, you agree that nott will not be held liable for any harm, injury, or damages resulting from meetings or interactions between users, including but not limited to physical, emotional, or psychological harm.

10. Intellectual Property Rights and Limited License

• All content, features, and functionality available on nott, including but not limited to text, graphics, logos, icons, images, audio clips, video, software, and other materials, are the exclusive property of nott, its licensors, or other content providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services and its content solely for personal, non-commercial use in accordance with these Terms.

• You agree not to:

  • Reproduce, modify, distribute, create derivative works of, publicly display, or otherwise exploit any of the content or materials available on the Services without prior written permission from nott or the respective rights holders.

  • Use any trademarks, service marks, or logos displayed on the Services without the owner’s prior written consent.

• nott reserves the right, but is not obligated, to remove or block any User Content that violates these Terms or is deemed inappropriate by nott at our sole discretion.

• By posting User Content on nott, you grant nott a worldwide, non-exclusive, royalty-free, fully-paid, sublicensable, and transferable license to use, reproduce, distribute, display, perform, and otherwise exploit the content for purposes related to the operation and promotion of the Services.

• This license continues even if you stop using the Services, though we may, at our discretion, remove certain content at your request.

11.4. Prohibited Content

The following types of User Content are prohibited ("Prohibited Content") on nott. This includes, without limitation, User Content that:

• Is obscene, pornographic, profane, defamatory, abusive, offensive, indecent, threatening, harassing, inflammatory, inaccurate, misrepresentative, fraudulent, or illegal;

• Promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;

• Is intended to, or does, harass or intimidate any other user or third party;

• May infringe or violate any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party, including User Content that contains others’ copyrighted content (e.g., photos, images, music, movies, videos, etc.) without obtaining proper permission;

• Contains video, audio, photographs, or images of another person without his or her express written consent (or, in the case of a minor, the minor’s legal guardian) or otherwise violates anyone’s right of privacy or publicity;

• Promotes or enables illegal or unlawful activities, such as instructions on how to make or buy illegal weapons or drugs;

• Violates someone’s data privacy or data protection rights;

• Contains viruses, time bombs, trojan horses, cancelbots, worms, or other harmful or disruptive codes, components, or devices;

• Contains any advertising, solicitation, or promotional content without prior written permission from nott;

• Is, in the sole judgment of nott, objectionable or restricts or inhibits any person from using or enjoying the Services, or exposes nott or its users to harm or liability of any type.

12. Limitations of Liability

To the fullest extent permitted by applicable law, in no event will nott, its affiliates, licensors, partners, or service providers, or any of their respective officers, directors, employees, agents, or contractors, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, emotional distress, or any damages resulting from:

• -Your access to or use of, or inability to access or use, the Services;

• Any conduct or content of any user or third party on the platform, including without limitation any defamatory, offensive, or illegal conduct;

• Any content obtained from the Services;

• Any unauthorized access, use, or alteration of your content or information;

• Any in-person meetings or interactions between users facilitated through the platform, including but not limited to any harm, injury, or damages resulting from such meetings;

• Any failure or delay in connection with the Services, including errors, interruptions, system failures, or downtime.

12.1. Cap on Liability

• To the fullest extent permitted by applicable law, nott's total liability to you for any claims arising out of or relating to the use of or inability to use the Services is zero. You acknowledge that nott provides a platform for user interaction and does not assume liability for user behavior, actions, or damages related to the use of the platform.

12.2. No Warranties

• The Services are provided on an “as-is” and “as-available” basis. nott expressly disclaims any warranties or conditions of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

• nott makes no warranty that:

  • The Services will be uninterrupted, secure, or available at any particular time or location;

  • Any errors or defects will be corrected;

  • The Services are free of viruses or other harmful components;

  • The results of using the Services will meet your expectations.

12.3. Jurisdictional Limitations

• Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, the liability of nott will be limited to the maximum extent permitted by law.
